Adoption Agreement
2010/2011

Adoption Fee: $1500.00, which includes the
non-refundable deposit of $150.00
All Native
American Indian Dog puppies (NAID's) will be fed and treated humanely with
proper veterinarian care by their new owners. No NAID is sold as a total housedog
or an apartment dog. There must be a suitable containment area for the animal
to be able to run and play off leash at will. No NAID may be chained to a
stationary object (i.e. a tree) but can be allowed to run on a cable system.
All fees must be
paid in full prior to the puppy leaving Night Eyes Farms premises. If picked up
at the kennel, we will accept cash only. If the pup is to be shipped, fees must
be paid via Money Gram money order, US Postal money order or Western Union
money order. All shipping costs are the responsibility of the buyer. This
includes travel time, airfare,
crate and veterinarian health certificate.
All pups will be
wormed at least 3 times and given their first vaccination. All pups are sold
with a 48-hour genetic health return policy (with proper documentation) at the owner’s
expense. We will reimburse with another pup and will ship at our expense. If it
is determined by our vet that the pup has been abused, physically, or mentally,
we will not offer a refund of any type, and will contact your local authorities.
Night Eyes Farms is not
responsible for any illnesses; injuries or disease incurred after the pup
leaves our premises, this includes Parvo.
We offer a 2-year
hip dysphasia guarantee with the following conditions:

Two
written diagnosis from two different practicing veterinarians, and all X rays
and reports must be sent to our vet for evaluation.

The
owner will pay for the pup to be euthanized. With proof of the procedure,
written by your vet on his letterhead. Night Eyes Farms will provide the owner with
a replacement pup within 9 months. In case we have any questions, you must
provide your vets office with a records release giving them permission to
verbally speak with us about your dog’s medical issue. You may elect to keep
the pup, and we will refund half of the original purchase price. We will not
refund any medical costs of any type.

If
your vet suspects hip dysplacia at a early age, we must be notified
immediately, however, the pup must be examined and radiographs must be taken
again at 2 years of age. We will not offer any refunds before the age of 2. The
diagnosis from the vet must clearly state that the hip ailment is caused by a
hereditary problem and NOT from rapid growth due to improper feeding, or as a
result from abuse or injury while in it's owners care. A certificate of
spay/neuter at the age of 6 to 10 months must accompany the vets report and
X-rays. The vet report must clearly state that the animal has not produced
puppies (females only.) We will have our own vet examine the x rays and reports,
and if they agree, the breeder and owner will agree on a mutually acceptable
form of reimbursement.
We offer a 2-year
hereditary health guarantee with the following conditions:

If
your pup should die within that time as a direct result of a congenital defect,
this (excludes hip dysplacia), the puppy will be replaced at the
breeder-seller's expense, only if an appropriate necropsy is performed by a
licensed vet and certification must be provided as proof of cause of death, and
death is not due to anything caused or related to buyer, buyers home, or
anything buyer may have exposed to the puppy. A replacement will come from the
next available litter, a refund may be offered at the breeder’s discretion,
including shipping cost.
Our pups are on a
regular de-worm schedule, however, this guarantee does not cover any of the
following conditions: intestinal parasites (Coccidiosis, Giardia, Tapeworms,
Hookworms, Roundworms or Ring worms) This guarantee does not cover any
Veterinarian costs associated with spaying or neutering, un-descended testes,
umbilical or Inguinal hernia’s. In most cases, these hernia’s close as
the pup matures. If they do not, they can be repaired when the pup is spayed or
neutered. Your pup will come with his/her dewclaws intact. We do not reimburse
for their removal.
YOU MUST WAIT UNTIL
YOUR PUP IS AT AN APPROPRIATE AGE BEFORE ENGAGING IN ANY STRENUOUS EXERCISE,
HIKING OR PLAY. YOUR VET CAN ADVISE YOU FURTHER.
Buyer understands
that animals are a life long commitment. Adding a puppy to your home is
just like bringing a baby into your family. The puppy will require a good deal
of time, attention and training to help them become the loving family member
you desire. The NAID is a highly intuitive breed and will sense the presence of
any negative feelings or energies in the household, whether directed toward the
dog or other family members. This can lead to training and behavioral issues.
Therefore, all members of the household must want this puppy and be committed
to its training. A Formal PUBLIC puppy obedience class is a requirement of Night
Eyes Farms, and we are not responsible for behavioral or socialization problems
resulting from inconsistent, improper or lack of training, including abuse and
mental trauma to the puppy by unsupervised children.
As a responsible
puppy provider, you may return your pup/dog at your expense. Your rescue will be boarded at a professional
kennel of our choosing until a qualified home is found. Professional
kennel board costs average $20.00 a day and must be paid 3 months in advance. All
shipping and board related costs are the responsibility of the owner, and MUST be
paid prior to acceptance of the rescue. Owner relinquishing said rescue will not
be reimbursed for purchase price/nor any associated costs with the
transportation, care and placement into a new home. We are very happy to assist
you in the placement of your rescue, free of charge if you elect to keep
him/her at your residence until a new home is found. We offer website
submittal, and we also maintain a list of people interested in adopting
rescues. We offer no guarantee’s that your rescue will be adopted, nor if you
will be given a re homing fee by potential adopters. Be responsible in your decision to purchase any animal, as we
do not condone animals regarded as throw away possessions. If you are in a
unstable relationship or are in financial hardship, please reconsider waiting
to adopt a new puppy until you have a stable lifestyle, and can offer a for
ever home. NAID’s bond strongly with their families, and some do not do well
being re-homed.
All puppies sold
must be spayed or neutered by 6 to 10 months of age. This helps prevent sexual disposition changes
in both male and females, as well as unplanned litters. Night Eyes Farms will
refund the cost of spay or neuter up to $50.00 per puppy upon receipt of proof
that the procedure was completed and a certificate of completion of the
required puppy class must be attached.
We do our best to
predict the amount of pups that a female will have. However, we are at the
mercy of Mother Nature. IF we don't have a pup for you, your name will be added
to the next litter list. Being that we take deposits for future litters in
advance, we cannot offer you first choice from that litter, your name will be
added to the next available slot.
This contract is
legal and binding and is non-transferable. WE RESERVE THE RIGHT TO CANCEL
AND REFUND YOUR DEPOSIT AT OUR DISCRETION, AT ANY TIME.
EFFECTIVE IMMEDIATELY! DUE TO THE AMOUNT OF BOUNCED CHECKS AND FRAUD, WE WILL
ONLY ACCEPT USPS MONEY ORDERS FOR DEPOSITS.
